All quotes provided by YOUR DIGITAL MOVIE LLC are valid for thirty (30) days unless otherwise specified. Due to the fluctuating costs of electronic components, final pricing may be adjusted if the project scope changes or if manufacturer prices increase prior to finalizing the order. Payment schedules, including required deposits for custom orders and final balances upon installation, will be detailed in your individual service agreement. Late payments may incur a fee of 1.5% per month or the maximum rate permitted by law.
For equipment-only purchases, the risk of loss and title for items pass to you upon our delivery to the carrier. For products delivered and installed by our technicians, the risk of loss passes to you upon the completion of the delivery at your specified premises. Delivery and installation dates are estimates and are not guaranteed.
For in-home installations and acoustic treatments, the client must ensure the premises are safe, accessible, and prepared for our technicians. This includes providing adequate power sources, network infrastructure (e.g., stable Wi-Fi), and structural integrity for mounting heavy equipment. We are not responsible for delays or additional costs caused by pre-existing structural issues, hazardous materials (e.g., asbestos), or network incompatibilities.
Manufacturer Warranty: All high-fidelity equipment and electronic components are covered solely by their respective manufacturer’s warranties. We will assist clients in facilitating warranty claims where reasonably possible.
Workmanship Warranty: YOUR DIGITAL MOVIE LLC warrants that installation services will be performed in a professional and workmanlike manner. This labor warranty is valid for ninety (90) days from the date of completion.
Disclaimer: EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT ANY ADDITIONAL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Due to the bespoke nature of our business, special-order items, custom-cut cables, and acoustic panels are strictly non-refundable. Standard inventory items may be returned within fourteen (14) days of purchase, subject to a 20% restocking fee, provided they are in their original, unopened packaging. Installation deposits are non-refundable once work has commenced or equipment has been ordered.
The Service and its original content, features, functionalities, and website design are and will remain the exclusive property of YOUR DIGITAL MOVIE LLC and its licensors. Our intellectual property may not be used in connection with any product or service without our prior written consent.
To the maximum extent permitted by applicable law, in no event shall YOUR DIGITAL MOVIE LLC, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; or (iii) unauthorized access, use, or alteration of your transmissions or content. Our total cumulative liability shall not exceed the total amount paid by you for the specific product or service in dispute.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be determined by binding arbitration in the State of California, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
